Seafield temple riot: 17 men acquitted, discharged

27-06- 2023 05:20 PM

PETALING JAYA: The Magistrates Court here today acquitted and discharged 17 men who were accused of rioting at the Seafield Sri Maha Mariamman Temple in Subang Jaya five years ago, without calling for their defence.

Magistrate Muhammad Iskandar Zainol made the decision after the prosecution had failed to establish a prima facie case against the group at the end of the prosecutions case.

In his ruling, Muhammad Iskandar said the court found that witnesses in the case had failed to identify the accused persons involved in the case and the witnesses statements in the court were inconsistent.

The prosecution also did not tender any weapon in court as an exhibit such as a knife as stated in the charge sheet.

All the weapons were merely collected from the scene by the witnesses and not seized from the accused persons, he said.

The 17 who were acquitted are Saifullah Abdullah, Muhammad Riduan Sekh Ruslan, Irwan Noordin, Mohamad Khairi Abdul Rashid, Rozaihan Zakaria, Muhammad Qayyum Mohd Faisal, Mohd Ashraf Mohd Faizal, Absal Eastrie Abdullah, Mohamed Jalil Talib, Muhammad Khairol Anuar Zabidi, Mohd Zamri Md Said, Shukri Razali, Nor Azmi Abdul Ghani, Mohammad Shahril Danniel Sajeel, Muhammad Hasneezam Shah Samsudin, Akmal Izzat Azi and Mohd Norul Ismawi Islahuddin.

The men, aged between 24 and 47, were charged with rioting and possessing dangerous weapons between 2 am and 5 am on Nov 26, 2018.

They were charged under Section 148 of the Penal Code, which carries a maximum penalty of five years imprisonment, a fine, or both, upon conviction.-Bernama

Apex court affirms decision declaring amended pension law null and void

The Federal Court here today affirmed the Court of Appeal's decision that declared the amended pension law as null and void. - PEXELS

PUTRAJAYA: The Federal Court here today affirmed the Court of Appeal's decision that declared the amended pension law as null and void.

The five-member bench led by Court of Appeal President Tan Sri Abang Iskandar Abang Hashim unanimously dismissed the appeal by the Malaysian Government and Public Service Department (PSD) director-general to overturn the appellate court's decision.

The others on the bench were Chief Judge of Malaya Datuk Mohamad Zabidin Mohd Diah, Chief Judge of Sabah and Sarawak Tan Sri Abdul Rahman Sebli, and Federal Court judges Datuk Seri Hasnah Mohamed Hashim, Datuk Rhodzariah Bujang.

In delivering the court's decision, Justice Mohamad Zabidin said Section 3 and Section 7 of the Pensions Adjustment (Amendment) Act 2013 (PAA), which allows a two per cent increment annually, were less favourable to pensioners and thus contravened Article 147 of the Federal Constitution (which provide for the protection of pension rights).

"It is our unanimous decision that there is no merit in the appellants' (the government and PSD director-general) appeal. The appeal is therefore dismissed and the decision and order of the Court of Appeal is affirmed," he said.

Justice Mohamad Zabidin also said both the High Court and Court of Appeal have observed that the amended Section 3 (2) of the PAA was in fact an acknowledgement that the amendments could result in a less favourable situation.

Justice Mohamad Zabidin said the appellate court was right to point out that the less favourable situation may never be rectified as the mechanism provided under the amended section 3 (2) of the PAA to address a less favourable situation should it arise, was merely 'permissive" and imposes no obligation to act.

The amended Section 3 (2) of the PAA states that where the application of a speci...

LOS ANGELES/GLASTONBURY: Call it Beyflation. Or maybe Swiftflation.

The cost of certain goods is retreating in some places, but that doesn't include live music. Concert tickets have surged in price, to the point where economists are noticing.

Fans are shelling out a fortune for tickets to see the world's biggest music acts, including names like Taylor Swift and Bruce Springsteen who haven't toured for years. And while few doubt the star power of Beyonc live, until now people weren't factoring her into national inflation figures.

"People are willing to splurge because they know they will get quality content, plus who knows when or if she'll do another tour after this one," said London-based Beyonc fan Mario Ihieme.

The United Kingdom's recreation and culture prices rose 6.8% in the year to May 2023, their fastest in 30 years, with the largest effect from cultural services, "particularly admission fees to live music events".

Event prices in UK inflation data are based on when shows take place, not when tickets are bought. But with different artists performing every month, it's hard to compare one to the other, an Office for National Statistics spokesperson said.

"The (subjective) quality of music artists emphasises how difficult it is to calculate a 'clean' price increase," said UBS Global Wealth Management chief economist Paul Donovan. "And for UK inflation, the pressures may persist," he added, noting a string of UK gigs by singer Harry Styles in June.

A perusal of ticket-purchasing sites makes the sticker shock clear. On reseller Stubhub, the cheapest seat for a July Taylor Swift show in Seattle is $1,200; tickets for an August Mexico City show cost $500 each.

"I had to get nine phone numbers for three different accounts on Ticketmaster under three different credit cards," said Joel Barrios, a Beyonc fan in Los Angeles. He spent about $7,000 on three U.S. shows for himself and friends - as well as another $6,650 for several shows in Europe.

Others say they had an easier time. Carolina Candelas spent 92 euros ($101) each to see Beyonc with her sisters and parents in Barcelona. "My sister purchased them in a presale link that Ticketmaster sent her, so I think it was really easy," she said.

But with live music just a subset of overall entertainment costs, which account for a smaller part of consumer spending than housing or food, some questioned the idea that concert prices could have an ap...

Dutch court rules sultan's heirs cannot seize Malaysian assets

June 27, 20235:28 PM GMT+8

THE HAGUE, June 27 (Reuters) - A Dutch court of appeal dismissed a bid by eight descendants of a former sultanate to enforce a $15-billion arbitration award they had won against the government of Malaysia, a judgment released on the court website Tuesday showed.

"The court dismisses the requests of the Filipino nationals" to demand to execute the arbitration award, the judgment said.

Last year, the Filipino heirs to the last sultan of the remote Philippine region of Sulu were awarded $14.9 billion by a Paris arbitration court in a long-running dispute with Malaysia over a colonial-era land deal.

They have since sought to seize Malaysian government assets in France, Luxembourg and the Netherlands, in a bid to enforce the award.

Malaysia, which did not participate in the arbitration, maintains the process is illegal and has vowed to fight the seizures. It obtained a stay on the award in France but the ruling remains enforceable overseas under a U.N. treaty on arbitration.

The heirs in September had sought permission from a Dutch court to enforce the award in the Netherlands, Reuters reported.

However, Dutch judges sided with Malaysia and said that the original agreement did not have a clause that bound parties to arbitration and the French stay of the award meant the claim was not enforcible in the Netherlands.

KUALA LUMPUR: Kuala Lumpur Police will be conducting a massive integrated traffic operation to curb various traffic offences, in collaboration with other enforcement agencies starting July 1.

Kuala Lumpur Police chief Datuk Mohd Shuhaily Mohd Zin said the Traffic Investigation and Enforcement Department will work with the Road Transport Department (RTD), Kuala Lumpur City Hall (DBKL) and the Department of Environment (DOE).

"This operation will involve about 1,000 officers and police personnel with the respective agencies focusing on the offences under their own jurisdiction," he said during the Kuala Lumpur Police Obey Traffic Rules Operation participated by the other agencies, at the KL Police Contingent Headquarters here today.

Mohd Shuhaily listed illegal parking, obstruction of traffic, running red lights, illegal number plates, illegal tinting and various offences related to motorcycles as the targets of the integrated operation.

He said errant road users would also be educated on the dangers of not obeying traffic rules under Op Didik, throughout the undertaking.

"Police will also do background checks for arrest warrants and criminal records, detect stolen vehicles and take action against workshops which carry out illegal modifications.

"The Kuala Lumpur Narcotics Criminal Investigation Department will jointly take action on drug-related cases throughout the operation," he said.

Mohd Shuhaily said the exercise is intended to prevent such offences from going out of control and any untoward incidents, as the police will not compromise with anyone involved in criminal activities or traffic offences.

"The nature of this operation is to discipline, educate and advise road users to obey all traffic rules as well as the rules of the other enforcement agencies involved," he said.

For the record, 895 traffic investigation papers were initiated from Jan to May this year with the highest number of offences being obstruction of traffic, including illegal parking, at 311 cases followed by 180 cases of illegal racing and 167 cases of running red lights.

NILAI: Police arrested a man after he was believed to have violated the honor of a popular female artist in Dataran Nilai, Sunday night.

Nilai District Police Chief, Supt Abdul Malik Hasim said, the incident happened at about 11.05pm when the artist had finished performing a song. "The police received a complaint from a 26-year-old female singer stating that at the time of the incident she was in a special guest room behind the square stage and had just finished performing.

"The singer was then approached by the suspect who asked for permission to take a selfie with him and after finishing the selfie, the man pulled and held his hand and then kissed the victim's hand," he said. Commenting further, he said, surprised by the action, the female singer continued to scream before the suspect ran away. The suspect was however successfully arrested by the organizers before being handed over to the police officers on duty at the festival. "The suspect is a local male and has no criminal record and the remand application for the suspect has been made at the Seremban Magistrate's Court. "The court allowed the suspect to be remanded for three days until this Wednesday," he added.

KUALA LUMPUR: The Hague Court of Appeal in the Netherlands will decide tomorrow on the Sulu claimants' application for the recognition and enforcement of a purported arbitral award of US$14.9 billion (RM62.59 billion) issued against Malaysia in February last year.

The court will also decide on whether the purported final award issued by a Spanish arbitrator, Dr Gonzalo Stampa in 2022 to the eight individuals claiming to be heirs of the Sulu Sultanate may be enforced in the Netherlands.

In their bid to enforce the US$14.9 billion final award, the Sulu claimants were reported to have attempted to seize Malaysia's oil firm Petronas' assets in Luxembourg, assets in the Netherlands and also targeted Malaysia's diplomatic assets in France (including part of its embassy).

On April 19, the Sulu Secretariat in a statement said the Hague Court of Appeal had heard submissions from the Government of Malaysia and the Sulu claimants during the proceeding held on April 17.

During the proceeding, Malaysia submitted its defence that the Sulu claimants' application for the recognition and enforcement of the purported final award issued by Stampa against Malaysia is null and void and their request is inadmissible and therefore, must be denied.

The secretariat said Malaysia is committed to safeguarding its sovereignty and upholding the sanctity of the international commercial arbitration process and laying bare the claimants' frivolous attempts to enforce a sham award that is null and void.

"This is an attempt to hold a sovereign state to ransom and the continued existence of the award tarnishes the reputation of the globally respected arbitration system," it said.

On June 14, Prime Minister Datuk Seri Anwar Ibrahim said that so far the Sulu claimants had taken legal action against Malaysia in four countries, namely Spain, France, Luxembourg and the Netherlands, and the Malaysian government has taken and is taking various counter-legal actions against them.

He said as a result of these active counter-measures, the Malaysian Government on June 6 received a piece of good news when the Paris Court of App...

An airport worker in the US has died after being sucked into a plane engine, officials have said.

The employee, who has not been named, was "ingested" into an engine at San Antonio International Airport in Texas on Friday, the National Transportation Safety Board (NTSB) said.

The incident happened at 10.25pm local time when a Delta Air Lines flight from Los Angeles taxied to its gate on one engine.

It is not clear how the person was sucked into the engine and the NTSB is investigating the incident.

According to the Federal Aviation Authority, the employee was a ramp worker.

In a statement, the airport said: "We are deeply saddened by this incident and are working with authorities as they begin their investigation.

"We will share more information as details become available."

Delta Air Lines said it was "heartbroken" over the incident and the loss of a member of its "aviation family".

"Our hearts and full support are with their family, friends and loved ones during this difficult time," it added.

A similar incident also occurred late last year in Alabama, when an airport worker was pulled into a plane engine.
